TERMS OF SERVICE

Last updated: 3 October 2026

Welcome to Dirdy Birdy.

These Terms of Service apply to your use of www.dirdybirdy.com and to purchases made through our online store. By accessing our website, placing an order or using our services, you agree to these Terms of Service.

Throughout these terms, “Dirdy Birdy”, “we”, “us” and “our” refer to the business operating www.dirdybirdy.com.

1. ONLINE STORE TERMS

By using this website, you confirm that you are legally capable of entering into a binding agreement in your jurisdiction.

You must not use our products, website or services for any unlawful or unauthorised purpose.

You must not transmit viruses, malicious code or anything intended to interfere with the operation or security of our website.

We reserve the right to refuse service where reasonably necessary, including where we suspect fraud, misuse of our website or unlawful activity.

2. PRODUCTS

We make reasonable efforts to display our products, colours, fabrics, details and sizing as accurately as possible.

However, colours may appear differently depending on your screen, device settings and lighting.

Measurements and sizing information are provided as a guide. Where possible, please refer to the size guide provided on the relevant product page before ordering.

We may modify or discontinue products from time to time without notice.

Product availability is not guaranteed until your order has been accepted.

3. PRICING

Prices are displayed in the currency shown on our website.

Prices may change from time to time.

For Australian customers, prices may include Goods and Services Tax (GST) where applicable.

For international orders, import duties, taxes, VAT, customs charges or other fees may apply depending on the destination country and the shipping method selected.

Any applicable duties or taxes collected by us will be shown at checkout where available.

Where duties or taxes are not collected at checkout, the customer may be responsible for paying them to the relevant customs authority, postal service or carrier before delivery.

We are not responsible for charges imposed by foreign governments or customs authorities that were not collected by us at checkout.

4. ORDERS

Submitting an order does not necessarily mean that we have accepted it.

We may cancel or decline an order where reasonably necessary, including where:

  • a product is unavailable;
  • there has been an obvious pricing or listing error;
  • payment cannot be authorised;
  • we reasonably suspect fraud or unauthorised activity; or
  • we are unable to ship the order to the nominated destination.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order.

We may limit quantities purchased where reasonably necessary, including where we believe products are being purchased for unauthorised resale.

5. PAYMENT

Payment must be made using one of the payment methods available at checkout.

By providing payment information, you confirm that you are authorised to use the relevant payment method.

Payments may be processed by third-party payment providers. Their own terms, privacy policies and security practices may also apply.

We do not guarantee that every payment method will always be available.

6. SHIPPING AND DELIVERY

Orders are shipped in accordance with our Shipping Policy and the delivery options displayed at checkout.

Delivery estimates are estimates only and may be affected by circumstances outside our control, including postal delays, customs processing, weather events and carrier disruptions.

Where tracking is available, tracking information will be provided after your order has been dispatched.

Customers are responsible for providing an accurate and complete delivery address.

If an order is returned to us because an incorrect or incomplete address was supplied, additional postage charges may apply before the order can be resent.

Nothing in this section limits any rights you may have under the Australian Consumer Law.

7. INTERNATIONAL ORDERS

International customers are responsible for ensuring that products purchased from Dirdy Birdy may lawfully be imported into their country.

Customs authorities may inspect packages and may require additional information from the recipient.

Unless duties and taxes are specifically shown as prepaid or collected at checkout, international customers may be responsible for duties, VAT, taxes, customs processing fees and carrier charges imposed on import.

If an international shipment is refused or returned because applicable import charges have not been paid, any refund will be handled in accordance with our Returns Policy and applicable law.

8. RETURNS, EXCHANGES AND CHANGE OF MIND

Change-of-mind returns and exchanges are governed by our Returns & Exchanges Policy.

Any additional return or exchange conditions we offer are separate from your statutory rights under Australian Consumer Law.

Nothing in our Returns Policy or these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law.

9. FAULTY, DAMAGED OR INCORRECT ITEMS

If you receive an item that is faulty, damaged, incorrectly described or different from what you ordered, please contact us as soon as reasonably possible.

Under the Australian Consumer Law, goods sold in Australia come with consumer guarantees, including that they are of acceptable quality, match their description and are fit for any disclosed purpose. Business.gov.au

Depending on the circumstances and whether the failure is major or minor, you may be entitled to a repair, replacement, refund or other remedy.

Where a product is confirmed to have a problem covered by the Australian Consumer Law, reasonable return postage costs may also need to be reimbursed. ACCC

10. AUSTRALIAN CONSUMER LAW

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

The ACCC confirms these statutory consumer guarantees apply automatically and cannot be removed by a retailer's terms or warranty conditions. ACCC

11. HYGIENE AND SWIMWEAR

For hygiene reasons, additional conditions may apply to change-of-mind returns of swimwear and other intimate garments.

Any hygiene seals or protective liners supplied with a product should remain attached where required by our Returns Policy for a change-of-mind return.

These requirements do not limit your rights where an item is faulty or otherwise fails to comply with the Australian Consumer Law.

12. PROMOTIONS AND DISCOUNT CODES

Promotional offers and discount codes may be subject to additional conditions communicated at the time of the promotion.

Unless otherwise stated:

  • discount codes cannot be exchanged for cash;
  • only one discount code may be used per order;
  • discount codes may have expiry dates;
  • discounts may exclude certain products or collections; and
  • promotions may be changed or withdrawn before an order is placed.

Any promotion already validly applied to an accepted order will be honoured unless there has been an obvious error or fraudulent use.

13. GIFT CARDS

Gift cards, where offered, are subject to the conditions shown when purchased.

Gift cards cannot normally be exchanged for cash except where required by law.

Applicable expiry rules will comply with Australian law.

17. THIRD-PARTY SERVICES

Our website may use or link to third-party services, including Shopify, payment providers, shipping providers, social media platforms and other applications.

We are not responsible for third-party websites or services that we do not control.

Use of those services may be subject to their own terms and privacy policies.

18. WEBSITE AVAILABILITY

We aim to keep our website available and accurate, but we cannot guarantee uninterrupted or error-free access.

We may temporarily suspend or modify the website for maintenance, security, technical or operational reasons.

19. LIMITATION OF LIABILITY

To the maximum extent permitted by law, we are not liable for losses caused solely by circumstances outside our reasonable control or by misuse of our website or products.

However, nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability arising under the Australian Consumer Law.

20. PERSONAL INFORMATION

Personal information collected through our website is handled in accordance with our Privacy Policy.

By using the website or placing an order, you acknowledge that certain information may need to be provided to service providers such as payment processors, Shopify and shipping carriers in order to process and deliver your order.

21. ERRORS AND INACCURACIES

From time to time, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges or availability.

We may correct genuine errors when identified.

If an error materially affects an order you have already placed, we will contact you and provide an appropriate option, which may include cancelling and refunding the affected part of the order.

22. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The version that applies to your transaction will generally be the version published at the time you place your order, subject to any rights or obligations imposed by law.

The current version will always be available on this page.

23. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as severed to the extent necessary.

The remaining provisions will continue to apply.

24. GOVERNING LAW

These Terms are governed by the laws of Australia and the laws of NSW of which Dirdy Birdy operates.

Nothing in this section limits any rights a consumer may have under applicable consumer protection legislation.
